In accordance with the provisions of the Colombian legal framework for the protection of personal data, specifically the statutory law 1581 of 2012 and the regulatory decrees 1377 of 2013 and 886 of 2014, Company Security communicates its policies for the processing of personal data, in accordance with the provisions that have been enacted on the subject:
Article 15 of the Political Constitution of Colombia protects the rights to privacy, good name and habeas data. From this constitutional provision, the other rules that regulate data protection in Colombia are derived.

Statutory Law 1581 of October 17, 2012 establishes the minimum conditions for the legitimate processing of personal data of the owners. It also establishes the principles under which the information must be managed, imposing clear obligations on organizations.
Law 1581, was regulated by Decree 1377 of 2013 and 886 of 2014, which defined specific aspects regarding the collection of personal data, the content of the privacy policy and the national database registry, among other points addressed.
Company Security shares to all holders of personal data its treatment policies, in compliance with Article 13 of Decree 1377 of 2013.

2. Definitions

In order to apply this policy, the following concepts will be considered, without prejudice to the definitions stipulated in Law 1581 of 2012 and its regulatory decrees:
Data subject: Natural person who is the owner of the data being processed.
Authorization: Prior, unequivocal and informed consent of the data owner to carry out the processing of his/her personal information.

Personal data: any numerical, alphabetical, graphic, photographic, acoustic or any other type of information concerning determined or determinable natural persons.

Public personal data: Data that is not semi-private, private or sensitive. Public data includes, among others, data relating to the marital status of individuals, their profession or trade, and their status as merchants or public servants. Due to their nature, public data may be contained, among others, in public records, public documents, official gazettes and bulletins and duly executed court rulings that are not subject to confidentiality.

Semi-private personal data: Their access is subject to some degree of restriction, they are of interest to a certain sector or group of persons: for example, financial or credit data, social network profiles or similar.

Private personal data: They are related to the private sphere of individuals: merchants' books (natural persons), private documents, contact data, among others.

Sensitive personal data: Sensitive data are those that affect the privacy of the Data Subject or whose improper use may generate discrimination, such as those that reveal racial or ethnic origin, political orientation, religious or philosophical convictions, membership in trade unions, social organizations, human rights or that promote the interests of any political party or that guarantee the rights and guarantees of opposition political parties, as well as data relating to health, sex life, and biometric data.


Data Processor: The natural or legal person, public or private, or administrative body that, alone or jointly with others, processes personal data on behalf of Company Security, as a result of the existence of a legal relationship that binds it to the organization and delimits the scope of its action for the provision of a service.

Data processing: Any operation or technical procedure, whether or not automated, that allows the collection, storage, use, circulation and deletion of personal data.

3. Scope of application of the policy

The present policy of treatment of the information arises in response to the administrative, accounting, financial and operative management of Company Security. The service offered by Company Security is not carrying out treatment of personal data, since the information is produced, edited and modified by public entities of the Colombian state in the exercise of their functions, being possible to access it without intermediation of Company Security.

Company Security does not store the information provided by the information providers in its own databases, or use, circulates or deletes the information accessed by the users/clients.
Company Security only allows online content addressing, facilitating access to users/customers of the information published by means of the addressing, without processing the personal data published therein.

4. Principles of protection and rights of individuals

Personal data may only be collected for processing, and may only be subject to such processing, if they are adequate, relevant and not excessive in relation to the scope and the specific, explicit and legitimate purposes for which they were collected. Such data shall be processed in a fair and lawful manner.

Personal data processed may not be used for purposes incompatible with those for which the data were collected. Further processing for historical, statistical or scientific purposes shall not be considered incompatible.

Personal data shall be accurate and updated so that they truthfully reflect the current situation of the data subject. If the data were collected directly from the holder, the data provided by the holder shall be considered accurate, thus complying with the principle of truthfulness and data quality.

5. Processing and purpose of personal data

Company Security only processes personal data of its owners for the following purposes:
To attend to requests, complaints or claims raised by users/customers. 

To respond to governmental or judicial entities at their express request when they respond to duly grounded judicial or administrative orders.

Execute the billing processes to users/customers for additional services. 
Holders are informed that once the need to process their data ceases, such data may be removed from Company Security's repositories at the request of the holder, in accordance with the provisions of the following chapter:

6. Structure for the attention of the owners

Company Security has a department to ensure due attention to queries and claims related to the protection of personal data, in order to ensure the exercise of the rights contained in Article 15 of the Constitution of Colombia of the holders.

For this purpose, there are defined procedures to receive, process and respond to any request that is framed within the provisions of Articles 14 and 15 of Law 1581 of 2012. The established area is the Support Office.

Warning, Personal data will be sent to the following persons:

To the owner of the data, their successors in title or their legal representatives.
To persons authorized by the owner of the data.
To persons authorized by judicial or legal order.

In the latter case, in accordance with what has been established by the Constitutional Court (Decision C-748 of 2011), information will only be provided as long as the public or administrative entity justifies its request, indicating the relationship between the need to obtain the required data and the fulfillment of its functions.

The consultation will be answered within a maximum term of ten (10) working days from the date of receipt. When it is not possible to answer the consultation within such term, the interested party will be informed, stating the reasons for the delay and indicating the date on which the consultation will be answered, which in no case may exceed five (5) business days following the expiration of the first term.

The applicant, together with his letter by which he submits the consultation, must include the following information:

The claim will be attended within a maximum term of fifteen (15) working days counted from the day following the date of its receipt. When it is not possible to attend the claim within such term, the interested party will be informed of the reasons for the delay and the date on which the claim will be attended, which in no case may exceed eight (8) business days following the expiration of the first term.

Structure of the claim: The claimant, together with the written document by which he/she submits the claim, must ensure that the claim is addressed to Companysegurity.com:

Contain the identification of the Holder.

Contain the description of the facts that give rise to the claim.

Specify the address of the Holder.

Attach the documents that you want to assert in the formulation of the claim.

By submitting queries or claims, the holders of personal data may exercise the rights established in Article 8 of Law 1581 of 2012.

7. Knowledge of the policy

Company Security makes available the present policy of treatment of the information to all its owners, by means of the visualization of the same in the terms and conditions of use of the service. 

Additionally, all holders of personal data may request a copy of the policy of treatment of personal information by the means provided in Chapter V of this document.

Relationship with third parties

Third parties that may eventually provide services to Company Security that are directly or indirectly related to the processing of personal data, must comply with this policy for the processing of personal information, as well as declare under oath that they will comply with the guidelines established in Law 1581 of 2012 and other regulatory standards, ensuring respect for the human dignity of the owners.

Notwithstanding the provisions herein, the contractual links with each of the third parties will establish the obligations that will govern the provision of the service.

Validity of this policy

The validity of these policies begins on August 01, 2020. Any change, or substantial modification will be communicated to the holder through the appropriate means of communication.

Company Security automatically integrates the PUBLIC INFORMATION with its IA and its manual review, in accordance with the provisions of article 18, section II, second paragraph of the Law of Transparency and Access to Public Governmental Information.

which implies and constitutes public information not considered confidential because it is in Public Records or in public access sources such as the Judicial Bulletins themselves. The information contained in the results of Company Security BRASIL /PERU/CHILE / is attached to the official texts in terms of Article 14 section VII of the Federal Copyright Law.

The legal framework of Company Security is also circumscribed in articles 6, 8 of the Constitution and article 19 of the Universal Declaration of Human Rights dated December 10, 1948.

The present Conditions constitute the entire agreement between you and us.
