3. Nature of the Platform
Company Security operates as a technology platform that facilitates interactions between Candidates and Employers. Employers are responsible for the vacancies they post, the terms they offer, their recruitment and selection processes, and their hiring decisions. Candidates are responsible for the information they provide.
Posting a vacancy does not constitute a guarantee of employment, and submitting an application does not guarantee an interview, selection, hiring, or continued employment.
The Platform may provide technological tools for posting, searching, filtering, communication, or automation, without guaranteeing any particular employment outcome.

The Platform may remove content that violates these Terms, applicable law, third-party rights, or security policies, without prejudice to any applicable legal obligations.
7. Intellectual Property
The design, structure, code, software, databases, interfaces, text, graphics, logos, trademarks, trade names, audiovisual elements, and other components owned by Company Security are protected by applicable Colombian intellectual property laws, including Law 23 of 1982, Law 44 of 1993, Law 1915 of 2018, and any laws that amend or replace them.
Unless expressly authorized, users may not reproduce, transform, distribute, publicly communicate, sell, sublicense, reverse engineer, or commercially exploit protected components of the Platform.
Copyright protection arises upon creation of the work and does not depend exclusively on registration, in accordance with Colombian law.
Nothing in these Terms shall be construed as an assignment of copyright or industrial property rights unless expressly agreed.
8. Job Postings
The Employer is responsible for ensuring that each job posting is truthful, clear, verifiable, and compliant with applicable Colombian law and, where applicable, the laws of the place where the work will be performed.
Job postings must not contain discriminatory, misleading, or unnecessary requirements. Requirements relating to nationality, residence, age, sex, marital status, health conditions, or other characteristics may only be used where there is a lawful basis and a legitimate connection to the position.
The Employer must clearly disclose the nature of the position, principal duties, work arrangement, location or remote-work status, compensation where legally required or where stated in the posting, requirements, and other relevant information.
The Employer is responsible for ensuring that the job posting does not violate applicable labor, social security, data protection, equality, non-discrimination, intellectual property, consumer-protection, or other applicable laws.
Company Security may reject, suspend, or remove job postings that violate these Terms or present legal, security, or user-protection risks.
9. Employer Responsibilities
Employers are responsible for hiring decisions and for the legal relationship they establish with Candidates.
Company Security does not guarantee the authenticity, suitability, availability, experience, or hiring of any Candidate, except with respect to verification services expressly contracted and subject to the applicable service terms.
The Employer must use Candidate data only for lawful purposes compatible with the authorization granted by the data subject or another valid legal basis.
10. Candidate Responsibilities
The Candidate is responsible for the accuracy and updating of their résumé or CV, profile, documents, and other information they provide.
Candidates must not submit false or altered degrees, certificates, employment experience, references, or documents belonging to third parties.
The Platform may request clarification, restrict functionality, or suspend an account where there are reasonable indications of false information, fraud, or non-compliance, while respecting the user's rights and applicable law.
11. Personal Data Protection
Company Security will process personal data in accordance with Law 1581 of 2012, its implementing regulations, instructions issued by the Superintendence of Industry and Commerce, and other applicable Colombian laws.
Where, due to the nature of the Services, the location of data subjects, activities directed to the European Union, monitoring of individuals in the European Union, or any other circumstance, Regulation (EU) 2016/679, known as the General Data Protection Regulation (GDPR), applies, Company Security will implement the measures and safeguards required by that Regulation to the extent applicable.
Where applicable, Company Security will comply with the GDPR principles of lawfulness, fairness and transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity and confidentiality, and accountability.
Before collecting or processing personal data for purposes requiring consent, Company Security will obtain the data subject's prior, express, and informed authorization, except where an applicable legal exception applies.
Personal data may be processed for purposes related to account creation and administration, provision of Services, management of applications, communication with Employers, recruitment processes, security, fraud prevention, support, compliance with legal obligations, and other purposes disclosed to the data subject and legally permitted.
Data subjects may exercise the rights granted by applicable law, including the right to know, update, rectify, and request deletion of their data where legally permitted. Where the GDPR applies, data subjects may also exercise the rights provided under that Regulation, including access, rectification, erasure, restriction of processing, objection, and data portability, subject to the terms and exceptions established by European law.
Processing of sensitive data will be subject to the special rules established by Colombian law and, where applicable, the GDPR. Company Security will seek to avoid requesting sensitive data that is not necessary for the intended purpose.
Where processors, technology providers, cloud services, analytics tools, payment processors, or other third parties process personal data, Company Security will implement the applicable contractual, organizational, and security measures.

La información financiera, crediticia, comercial o de servicios is subject to the special rules of the régimen de habeas data, including Law 1266 de 2008 and its amendments.
Financial or credit information may not be used for employment decisions where prohibited by Colombian law. The Platform does not authorize Employers to use its tools for purposes other than those legally permitted.
13. Company Security AI and Automated Functions
Where the Platform offers application-automation, artificial intelligence, or similar functionality, its use will be subject to the applicable consent or authorization and the information provided to the user.
The user is responsible for reviewing and keeping current the information in their profile and résumé used by automated tools.
Automation does not guarantee employment, an interview, or a response from an Employer.
The Platform may establish technical, frequency, or usage limits to prevent abuse, spam, or harm to third parties.
Where a functionality involves processing personal data through automated tools, the Personal Data Processing Policy and applicable Colombian laws will apply.
14. Third-Party Links and Services
The Platform may contain links to or integrations with third-party websites, applications, or services. Such third parties may have their own terms and privacy policies.
Company Security does not necessarily control the content, availability, security, or privacy practices of third parties. Users should review the applicable terms before using their services.
The presence of a link or integration does not necessarily imply endorsement, affiliation, or warranty by Company Security.
15. Account Security
Users must keep their credentials confidential and promptly report any unauthorized access, lost password, or security incident.
Users are responsible for activities carried out through their account to the extent attributable to their conduct, negligence, or failure to follow reasonable security measures.
The Platform may implement technical controls, authentication, security monitoring, and fraud-prevention measures.
16. Service Availability and Continuity
The Platform will use reasonable efforts to keep its Services available and secure, but does not guarantee uninterrupted availability. Interruptions may occur due to maintenance, updates, provider failures, security incidents, force majeure, or other events beyond its reasonable control.
The Platform may modify, suspend, or discontinue functionalities, providing notice where reasonably possible and without prejudice to non-waivable rights applicable to consumers or users.
17. Consumer Protection and Electronic Commerce
Where Company Security acts as a supplier to a consumer within the meaning of Colombian law, it will comply with the applicable obligations under the Consumer Statute, Law 1480 of 2011, including applicable electronic-commerce rules.
Contractual terms will be made available so that users can access and retain them. Electronic acceptance may be recorded as evidence of the user's expression of intent in accordance with Law 527 of 1999.
No provision of these Terms is intended to exclude consumer rights that are non-waivable by law.
18. Limitation of Liability
To the extent permitted by Colombian law, Company Security will not be liable for decisions made exclusively by Employers or Candidates, content posted by third parties, the conduct of other users, or external services outside its control.
The limitations of liability will not apply where the law prohibits the exclusion or limitation of a particular liability, nor will they affect non-waivable rights of consumers, data subjects, or other persons protected by mandatory provisions.
The Platform does not guarantee specific employment outcomes, hiring, a particular number of interviews, compensation levels, or continued employment.
19. Indemnification
To the extent permitted by law, users will be responsible for damages, claims, or costs arising from their breach of these Terms, infringement of third-party rights, or unlawful use of the Platform, where there is a legal basis for attributing such liability to them.
This provision does not limit liabilities legally attributable to Company Security or impose obligations on consumers prohibited by Colombian law.
20. Account Suspension and Termination
Company Security may suspend or terminate an account in cases of breach of these Terms, fraud, unlawful activity, security risk, impersonation, abusive use of the Platform, or a reasonable inability to verify essential information.
Where appropriate, the Platform may notify the user of the measure taken and the available channels for submitting a request or complaint.
Termination of an account does not extinguish obligations that by their nature must survive, including confidentiality, intellectual property, payment obligations, and information processing in accordance with applicable retention rules.
21. Data Retention and Deletion
Company Security will retain the personal data of Candidates, Users, and other data subjects for an ordinary maximum period of sixty (60) calendar days, counted from the end of the specific purpose for which the data were collected or from the date on which the data are no longer necessary for that purpose, as applicable.
After sixty (60) days, Company Security will delete or anonymize the personal data, taking into account the nature of the information and applicable legal obligations.
The sixty (60)-day period is the ordinary retention period and does not prevent Company Security from retaining certain information for an additional period where required or permitted by law or regulation, by an order of a competent authority, by an ongoing contractual obligation, to address a claim, exercise or defend rights, comply with accounting or tax obligations, prevent fraud or security incidents, or for any other circumstance that legally permits or requires retention.
Where information is retained after sixty (60) days under any of the exceptions above, Company Security will restrict access to and processing of that information to the purpose justifying its retention and will delete or anonymize it when the basis for retention no longer exists.
Where the GDPR applies, Company Security will comply with the storage-limitation principle set out in Article 5(1)(e) of Regulation (EU) 2016/679 and will provide the data subject with information about the retention period or, where it is not possible to specify one, the criteria used to determine it, in accordance with Article 13(2)(a).
22. Electronic Records and Acceptance
Electronic communications, acceptance records, confirmations, emails, forms, and other data messages may be used as evidence of actions taken by users in accordance with Law 527 of 1999.
The user agrees that communications relating to their account, Services, security, transactions, and operation of the Platform may be sent electronically.
Where the law requires specific authorization, the Platform will use mechanisms designed to obtain and retain the corresponding evidence.
23. Changes to These Terms
Company Security may modify these Terms to reflect legal, technological, operational, or service changes.
The updated version will be published on the Platform with the applicable update date. Where a change requires express acceptance or special notice by law, the appropriate mechanism will be used.
Continued use of the Platform after an amendment takes effect may constitute acceptance where legally permissible and where the user has had reasonable access to the updated version.
24. Governing Law and Jurisdiction
These Terms shall be interpreted and applied in accordance with the laws of the Republic of Colombia, without prejudice to mandatory laws that may apply based on the user's or consumer's location, the processing of personal data, or the specific provision of the Services.
Disputes shall be submitted to the competent authorities and courts of Colombia in accordance with applicable jurisdictional rules.
Where a relationship qualifies as a consumer relationship, the jurisdictional and consumer-protection rules established by Colombian law will be respected.
25. Severability and No Waiver
If any provision of these Terms is declared invalid, ineffective, or unenforceable, the remaining provisions will remain valid to the extent permitted by law.
Company Security's failure to exercise a right will not, by itself, constitute a permanent waiver of that right.
